Family Law

There are various areas of family law, and we are pleased to offer a comprehensive service covering all of these fields. Regardless of the nature of the inquiry, it is essential that you seek legal advice immediately to ensure that your rights are safeguarded. We aim to provide a sensitive service at a difficult time in the Client's life, and are happy to discuss any matters which are causing our Client particular distress. Legal Aid is available for most areas of family law, depending on your financial eligibility.

A. Separations & Divorce

If you have separated from your spouse or partner, or intend to do so, early legal advice is indispensable. We can advise all the consequences of separation from a legal, financial and practical point of view. Clients are often worried about their children or how they will cope financially. We will take you through the various steps of separation, and can advise you if you wish to petition for a Divorce. There are various grounds for divorce, and we can guide you as to the appropriate one for your situation. It is possible to petition for Divorce in the County Court or the High Court and we can advise you as to the better option.

B. Financial Provision

After a separation, it is important that you receive expert legal advice as to how you will survive financially. You may be able to claim maintenance from your partner or spouse, both for yourself and your children. We provide a service throughout this process, from taking initial instructions to the applying to the Court for an Order if required.

After Divorce, we also assist in the division of the matrimonial property, whether in the form of negotiating a separation agreement, or else by representing you in an application to Court. This process requires a great deal of communication between Solicitor and Client, and we strive to provide a high level of ongoing contact to ensure that we can best serve your needs.

C. Children

Obviously children are the most important consideration when there are family problems. It is usually desirable for agreement to be reached regarding the living arrangements of the children of the family when the parents separate, and we will assist and represent you in any negotiations. It is not, however, uncommon for agreement not to be reached, and the matter is brought before a Family Proceedings Court.

It is essential that you obtain legal advice as soon as possible, in order that both your and your children's rights are safeguarded. Legal Aid is available for children-related cases, depending on your financial means.

D. Domestic Violence

This is a particularly serious and distressing aspect of family law and we aim to assist our Clients in a sensitive and vigorous manner. If necessary an emergency application can be brought to the Court removing the assailant from the family home and/or preventing them from coming near you. There are various kinds of occupation orders and non-molestation orders available, and we can advise you fully when we are aware of all the facts of your case. We understand the difficulty that Clients have in talking about problems such as these, and to that end we can provide a female solicitor or a male solicitor according to your wishes. Remember, there are mechanisms available to allow us to act immediately, therefore you should contact us as soon as the incident happens.

E. Adoptions

On a happier note, we are pleased to be able to assist you in the happier side of family law, namely the adoption of children. We can advise you on the various agencies and organisations involved with adoption, and we can guide you through the complex court procedure.
